Masoud Shamsnejad, the lawyer of four Kurdish political prisoners, wrote on his X page; Despite all the legal restrictions arising from the lack of access to the indictment file of his clients Vafa Azarbar, Mohsen Mazloum, Mohammad Faramarzi, and Pejman Fatehi, he referred their request for a retrial to the Supreme Court on January 9. The death sentence of Mohsen Mazloum, Mohammad Faramarzi, Vafa Azarbar, and Pejman Fatehi, four Kurdish political prisoners, was issued in absolute ignorance after more than a year and a half of detention and enforced disappearance, and the case was referred to the Supreme Court for confirmation of the death sentence.
According to an informed source to Kurdpa; The families of these political prisoners have been informed through repeated follow-ups in recent days that the death sentence of their children has been issued and the case is in branch 39 (probably) of the Supreme Court for confirmation of the death sentences. Also, security agencies, including the Ministry of Intelligence, have ordered the judicial authorities of the Supreme Court that the verdicts must be confirmed and executed quickly.
The informed source of Kurdpa confirmed that these prisoners have appointed lawyers and so far their families do not know who these lawyers are and have not had any contact with the families. On the other hand, the families have introduced Mr. "Masoud Shamsnejad" as the lawyer of their children to the judicial authorities, but Mr. Shamsnejad has not been able to see the case and has not received any response from the judicial authorities for a year and a half.
The source of Kurdpa admitted that the absolute ignorance of the families of these political prisoners from the case of their children is such that they do not even know whether the case has been finalized in the Supreme Court or not and they only know that the case is in one of the branches of this court and probably branch 39.
Mohsen Mazloum from Mahabad, Hejir (Mohammad) Faramarzi from Dehgolan of Sanandaj, Vafa Azarbar from Bokan, and Pejman Fatehi from Kamyaran, four members of the Komala Party of Iranian Kurdistan, were arrested by the security forces of the Islamic Republic in the village of "Yengjeh" in the suburbs of Soma region of Urmia in June 2022. For a year and a half, the families had no information about the whereabouts and fate of their children, and these prisoners were deprived of the right to access a lawyer, and contact and visit their families during this period.
The Islamic Republic has twice broadcasted forced confessions from these political prisoners. In this video of forced confession, the Islamic Republic claimed that they "intended to explode in one of the aircraft factories in Isfahan". However, the Komala Party of Iranian Kurdistan strongly rejected this claim and the charges of the Islamic Republic against its members and considered it as a document for the further suppression of Kurdistan and the struggles of the people, especially in the period of widespread protests in Kurdistan and Iran.
Given the scenario of the security agencies and the absolute ignorance of the fate of these four Kurdish political prisoners, the families of these prisoners have repeatedly asked international and human rights organizations to help their children be safe from the issuance of death sentences.
The Kurdpa Human Rights Organization, while strongly condemning the issuance of the death sentence against these political prisoners and expressing serious concern about the intensification of the execution of their sentences, emphasizes that the charges against these political prisoners without the right to access a fair trial and a designated lawyer are in contradiction with all human rights standards and even the laws of the Islamic Republic itself. It also considers the arbitrary detention of these individuals for more than a year and a half as enforced disappearance.
Earlier, Kurdpa had admitted that since there is no information about the fate of these individuals and the families are in absolute ignorance of the situation of their children and also considering the statements of the security agencies that even without considering the laws of the Islamic Republic and before the trial, they accused them of collaborating with "Mossad". The Kurdpa Human Rights Organization announced that they are in an unknown location without the right to access a lawyer and contact with the family, subject to unfair trial, forced confessions, and enforced disappearance.
