Baneh: Transfer of Hoshyar Shabani to Baneh Prison After 46 Days of Arbitrary Detention; 3 Billion Toman Bail Requested from Family

October 8, 2025; Hoshyar Shabani, a civil activist and political prisoner, was transferred to Baneh Prison on October 4, 2025, following the completion of his interrogation period after 46 days of arbitrary detention in a security detention center in Sanandaj. Currently, security and judicial institutions have requested a heavy bail of 3 billion Tomans for his temporary release. Throughout his detention, he was deprived of the right to visitation and access to a lawyer, only managing to make a single few-second telephone call during the initial days of his arrest following his family's persistent inquiries at security centers in Sanandaj. Furthermore, despite repeated follow-ups by the family during this period, security officials have refused to provide any information regarding his status, particularly concerning the injuries he sustained during his arrest.

In an interview with Kurdpa, an informed source confirmed the news of Hoshyar Shabani's transfer to Baneh Prison, stating that in recent days, judicial and security authorities requested a 3 billion Toman bail from his family for the right to temporary release.

On September 10, 2025, Kurdpa reported that after 22 days of arbitrary detention of Hoshyar Shabani—who was wounded by gunfire during his arrest—and Omid Ahmadpour, two Kurdish citizens from Baneh, no information was available regarding their fate or place of detention, and they remained deprived of family visits and access to a lawyer.

Additionally, the reasons for the arrest and the charges brought against these citizens remain unclear.

The Kurdpa Human Rights Organization has repeatedly warned about the physical condition and the life of Hoshyar Shabani, who was wounded in the leg by direct fire from security forces during his arrest and held in detention without any medical attention. It also emphasized that the continuation of arbitrary detention, lack of information about his condition, and the potential use of his injuries to exert pressure, extract forced confessions, and inflict torture constitute a clear violation of the principles of fair trial, the right to medical treatment, and the prohibition of torture.

Arrest of Hoshyar Shabani and Omid Ahmadpour:

On Wednesday, August 20, 2025, Hoshyar Shabani, a former political prisoner and Kurdish citizen from Baneh, was shot by security forces in a highly violent operation and was arbitrarily arrested and transferred to an unknown location after being wounded.

Also on Wednesday, August 20, 2025, following the violent arrest and direct shooting of Hoshyar Shabani's leg, security forces also arbitrarily arrested another young man from the city named "Omid Ahmadpour" without a judicial warrant, solely because Hoshyar Shabani was using his vehicle at the time of the arrest.

Hoshyar Shabani, a Kurdish citizen and former political prisoner, has consistently been under pressure, threats, and pursuit by the security forces of the Islamic Republic in recent years. From repeated arrests and security case-building to torture, deprivation of legal rights, frequent raids on his home, and threats against his relatives, his life has been continuously intertwined with the systemic violence of security apparatuses.

Security Threats and Pressure on Hoshyar Shabani in the Weeks Prior to Arrest:

Hoshyar Shabani had been under increasing security pressure from security forces since early July 2025. In several instances, intelligence security forces raided his home, as well as the homes of his relatives and friends, in an attempt to arrest him.

In one instance on June 29, 2025, a group of 20 people attacked the house of one of his relatives, but he had left moments earlier.

Security forces also contacted his relatives in villages, threatening them to have no contact with him or to hand him over if possible.

Subsequently, on July 10, 2025, security forces visited his home in the city under judicial pretexts. These actions are part of a pattern; two years ago, under the pretext of the anniversary of the "Jin, Jiyan, Azadi" (Woman, Life, Freedom) revolutionary uprising, they raided his home, confiscated his belongings without a legal warrant, and opened a case against him.

2023 Case: Security Case-building, Court Summons, and Pressure from Security Forces:

In late November 2023, Hoshyar Shabani was summoned to Branch 1 of the Interrogator's Office of the Public and Revolutionary Prosecutor's Office of Baneh on the charge of "propaganda against the regime." Prior to this, on September 4, 2023, security forces failed to arrest him despite raiding his home and subsequently built a case against him.

Then, on December 14, 2023, a total of nine security officers, posing as employees of the Water Department, raided his family home to arrest him and searched the premises. They also demanded the family hand over their son to the Baneh Intelligence Department by taking a forced commitment from them.

2021 Case: Arbitrary Detention, 81-Day Interrogation, Torture and Bleeding in Baneh Intelligence Detention Center, and Prison Sentence:

On Thursday, August 26, 2021, Hoshyar Shabani was arrested by security forces without a judicial warrant and transferred to a security detention center in Baneh for interrogation.

In early November 2021, he was transferred to Salahaddin Ayoubi Hospital due to stomach bleeding while in the Baneh Intelligence Department detention center, as security forces had subjected him to pressure and torture. Shabani was hospitalized for three days under security measures and was subsequently returned to the detention center. During his hospitalization, security forces prevented his family from visiting him.

On Sunday, November 14, 2021, Hoshyar Shabani was released from the intelligence detention center upon posting bail until the conclusion of the trial proceedings.

During his detention, he was allowed only one phone call with his family and was deprived of access to a lawyer and visitation rights.

Following the judicial process, Hoshyar Shabani was sentenced to one year of discretionary imprisonment by the Saqqez Revolutionary Court (sitting in Baneh) presided over by Judge "Akbar Mirzaei" on the charge of "propaganda against the regime" and was acquitted of the charge of "cooperation with one of the Kurdish parties." The court suspended eight months of his prison sentence for five years under supervisory conditions and declared that Shabani was required to periodically report himself to the Baneh Intelligence Department during the suspension period.

On February 7, 2023, he was arrested to serve his prison sentence and transferred to Baneh Prison.

Other Records of Arrests and Pressures (2017 to 2019):

Hoshyar Shabani also has a record of arrests, sentencing, and imprisonment during the years 2017, 2018, and 2019 due to civil activities, including the campaign to support Kolbars and strikes by shopkeepers and merchants.

He was first arrested by intelligence forces on Monday, October 14, 2019, and transferred to an unknown location. His fate remained uncertain for a long time, and his family's inquiries were unsuccessful.

Hoshyar Shabani, son of Mohammad, is 31 years old and from Baneh. As a civil activist, he has participated in campaigns supporting Kolbars and market strikes, for which he has been repeatedly arrested, tortured, and imprisoned.
