The medical commission's opposition to medical leave and treatment outside of prison for Siavash Hayati
The medical commission refused to grant medical leave and treatment outside the prison for Siavash Hayati, the spokesman of the Consultative Assembly of Civil Activists of Yarsan and the secretary of the United Kurdish Front, despite having multiple illnesses.
According to an informed source of Kurdpa, the medical commission justified that the spokesman of the Consultative Assembly of Civil Activists of Yarsan could tolerate imprisonment and did not agree with his medical leave and treatment outside the prison.
The informed source added: that Mr. Hayati returned to Diesel Abad prison in Kermanshah on December 1, after the medical commission rejected his request for medical leave.
On November 9, Siavash Hayati was sent on leave from Diesel Abad prison in Kermanshah and his leave was extended until December 1.
The spokesman of the Consultative Assembly of Civil Activists of Yarsan suffers from liver, lung, prostate, and high blood pressure diseases and his medical leave had not been agreed for the past six months.
On May 13, Siavash Hayati was transferred to Diesel Abad prison in Kermanshah after being summoned to the first branch of the criminal enforcement court of the public and revolutionary court of Islam Abad Gharb to serve his prison sentence.
The spokesman of the Consultative Assembly of Civil Activists of Yarsan had received a summons notice on May 6, to serve his prison sentence.
Siavash Hayati was arrested by security forces on September 23, 2022, in the village of "Vargameh" in Dalahoo district and went on hunger strike from the beginning of his arrest.
He was transferred from the Intelligence Office of Kermanshah to Diesel Abad prison on November 27, 2022, and was released on bail on October 8, 2022
Then, the spokesman of the Consultative Assembly of Civil Activists of Yarsan and the secretary of the United Kurdish Front was sentenced by Branch 5 of the Revolutionary Court of Kermanshah based in Islam Abad Gharb to one year of imprisonment for "propaganda activities against the system through interviews with television and media outlets and also addressing the victims of recent unrest and calling the Islamic Republic of Iran a tyrant" based on Article 500 of the Islamic Penal Code.
Another charge against Mr. Hayati was "inciting people to slaughter and war to disrupt the country's security", which the court acquitted him of due to the lack of evidentiary evidence to convince the conscience and also considering the principle of innocence based on Article 37 of the Constitution and Article 4 of the Criminal Procedure Code.
Also, Branch One of the Public and Revolutionary Prosecutor's Office of Sahneh district referred the case of the spokesman of the Consultative Assembly of Civil Activists of Yarsan and the secretary of the United Kurdish Front to the charges of "assembly and collusion to disrupt internal security and propaganda activities against the Islamic Republic of Iran" to the Public and Revolutionary Court of Tehran for trial.
In the final order of the court issued against Mr. Hayati, it is stated that Branch One of the Public and Revolutionary Prosecutor's Office of Sahneh district, by Article 419 and the verdict of Branch 5 of the Supreme Court and at the request of the Attorney General of the country, referred his charges to the judicial authorities of Tehran.
On November 30, 2022, Siavash Hayati and his companions, who had gone to Sahneh from Kermanshah to visit some of the released detainees of the November 18, ceremony, were arrested by security forces at the Biston highway police station without presenting a judicial order along with beating and abuse on their way back to Kermanshah.
On Wednesday, January 3, 2023, the spokesman of the Consultative Assembly of Civil Activists of Yarsan and the secretary of the United Kurdish Front were released from Diesel Abad prison in Kermanshah on bail after 33 days of detention and were summoned to Branch One of the Public and Revolutionary Prosecutor's Office of Sahneh district on charges of "assembly and collusion to commit a crime against internal security" in February 2023.
