Mahabad; Five Protesters Sentenced to Imprisonment, Lashes, and Fine
On Sunday, August 27th, five protesters named "Rahim Shamai" aged 26, son of Mohammad from Urmia, "Yasin Moustafapour" aged 25, son of Amir from Mahabad, "Salah Mousavi Rad" aged 28, son of Osman from Mahabad, "Iraj Ebrahimzadeh" aged 24, son of Jalal, and "Behnam Rasakhnia" aged 45, son of Mohammad Sultan from Mahabad were sentenced by Branch 101 of the Criminal Court of Mahabad, under the presidency of Judge Sajad Dehghanzadeh Estemal, to imprisonment, lashes, and payment of monetary fines.
According to the issued verdict, Rahim Shamai was sentenced to five years of imprisonment in grade 5 for charges of "destruction and looting of property combined with anger and assault," to one and a half years of imprisonment in grade 6 for "participation in deliberate destruction of property," to five years of imprisonment in grade 5 for "production and assembly of non-military explosive materials," and to pay double the value of the confiscated items to the Treasury of the Islamic Republic of Iran. He was also sentenced to two years of imprisonment in grade 6 for "rebellion against military and police officers," and one year of imprisonment in grade 6 for "disturbing public order and tranquility," along with 74 lashes.
Yasin Moustafapur was sentenced to five years of imprisonment in grade 5 for charges of "destruction and looting of property combined with anger and assault," to one and a half years of imprisonment in grade 6 for "participation in deliberate destruction of property," to two years of imprisonment in grade 6 for "rebellion against military and police officers," and one year of imprisonment in grade 6 for "disturbing public order and tranquility," along with 74 lashes.
Salah Mousavi Rad was sentenced to 42 months and one day of imprisonment in grade 5 for charges of "destruction and looting of property combined with anger and assault," and to one and a half years of imprisonment in grade 6 for "participation in deliberate destruction of property."
Iraj Ebrahimzadeh was sentenced to 42 months and one day of imprisonment in grade 5 for charges of "destruction and looting of property combined with anger and assault," and to one and a half years of imprisonment in grade 6 for "participation in deliberate destruction of property."
Behnam Rasakhnia was sentenced to five years of imprisonment in grade 5 for charges of "destruction and looting of property combined with anger and assault," and to one and a half years of imprisonment in grade 6 for "participation in deliberate destruction of property." He was also sentenced to 10 years of imprisonment in grade 4 for "burning the marriage document belonging to Asghar Mohammadi."
According to Article 134 of the Islamic Penal Code approved in 2013, the harshest punishment can be implemented for these individuals. If the harshest punishment is reduced, changed, or becomes unenforceable due to legal reasons, the next harshest punishment will be implemented.
The issued verdict against Rahim Shamai, Iraj Ebrahimzadeh, and Behnam Rasakhnia was present, and within twenty days, they can request a review at the Court of Appeals. The verdict against Yasin Moustafapur and Salah Mousavi Rad was issued in absentia, and within twenty days from the date of actual notification, they can request a review at Branch 101 of the Criminal Court of Mahabad. These five citizens were arrested by suppressive security forces during the protests of Jin, Jiyan, Azadi.
