Confirmation of the prison sentence of Osman Esmaili, a labor activist, in the Supreme Court

The sentence of imprisonment of Osman Esmaili, a labor activist from Saqqez, was confirmed in the Supreme Court.

This labor activist, based on the notification he received on Monday, October 30, from the second branch of the criminal sentence enforcement of the Saqqez General and Revolutionary Prosecutor's Office, must present himself to this branch within 10 days for the execution of the sentence.

 On August 28, Osman Esmaili along with his lawyer Farzad Nasrallahi filed a protest against the decision of the court of first instance and sent the bill of appeal to the Supreme Court.

 This labor activist was sentenced to 31 months and 15 days in prison by the first branch of the Revolutionary Court of Saqqez on the charge of "membership in the Kurdistan Organization of the Communist Party of Iran" and on the charge of "propaganda against the regime by participating in the funeral of Jina Amini" to seven months and 15 days in prison.

The court, taking into account the mitigating factors contained in Article 38 of the Islamic Penal Code approved in 2013, including the age status of Mr. Esmaili and being married, based on the recent article of Al-Eshara and Article 6 of the Law on Reducing the Punishment of Imprisonment approved in 2019, which refers to Article 37 of the Penal Code.  Islamic law approved in 2013 had reduced the above severe prison sentence to 16 months of imprisonment including the days of previous detention.

On June 18, 2023, the court hearing on the charges of Osman Esmaili was held under the chairmanship of Judge "Javad Mostafaei", the head of the first branch of the Saqqez Revolutionary Court, and "Keyvan Jahani", the advisor of the Saqqez Revolutionary Court.

On February 8, 2023, Mr. Esmaili was arrested by the security forces in "Shohada" street of Saqqez without a court order, and after a week he was transferred from the Saqqez Intelligence Department Detention Center to the Sanandaj Intelligence Department Detention Center.

On the 15th of March 2023, this labor activist was transferred from the Sanandaj Intelligence Department detention center to Saqqez prison.

On the 17th of April, Osman Esmaili was temporarily released from Saqqez prison by posting bail of one billion tomans until the end of the proceedings.
